Rear-End Accident Kills Five-Year-Old Tennessee Boy

Posted in Car Accident,Distracted Driving on October 27, 2014

Earlier this month in Leesburg, Florida, a tragic accident claimed the life of a young Tennessee boy when the car in which he was riding was rear-ended. According to a report by Click Orlando, the accident involved a 2010 Kia Soul with three passengers inside and a bucket truck owned by Sumpter Electric Cooperative.

The two adult passengers in the Kia were flown to Leesburg Regional Medical Center. They were both admitted in serious condition, but they are expected to fully recover. The young child, however, was flown to Arnold Palmer Hospital, where he was pronounced dead from the injuries he sustained in the accident.

Police are currently in the midst of an investigation into the cause of the accident. At this point, police are saying that alcohol was not involved in the fatal accident. However, the investigation is ongoing, and charges are pending against the truck driver.

Rear-End Accidents Are Often Caused By Distracted Driving

Rear-end accidents are some of the more dangerous types of accidents we see because often the car that is rear-ended has no idea that the impact is coming and is completely unprepared. These kinds of accidents, while incredibly dangerous, are also almost always preventable.

Most rear-end accidents are not caused by a driver’s inability to slow down in time, but by the driver’s failure to perceive the events around him or her in a timely manner. Often, rear-end accidents are caused by distracted drivers who are on the phone, texting, daydreaming, or engaged in some other kind of distracted driving.

Just because a car wreck is an “accident” and not intentional does not mean that the victim of the accident cannot seek compensation for his or her injuries. Negligent drivers are routinely held liable for the damages and injuries they cause while negligently operating their vehicles. Most of the time, accident victims end up recovering through the legal doctrine of “negligence.” Negligence requires that a plaintiff prove that the other driver owed him or her some duty of care that the other driver violated. In addition, the plaintiff must prove that the other driver’s violation of that duty is what caused his or her injuries.
